Smerio / Legal
Terms of Service
Initial version · Updated
1. Scope and operator
These initial terms describe use of the Smerio website and Hub preview. Smerio is the project name; the operator’s legal name and postal address are pending confirmation. Questions may be sent to support@smerio.com. These terms must be completed before they are relied on as final commercial contracting terms.
Use the service only if you are an adult able to enter into an agreement and, when acting for an organisation, authorised to do so. Separate signed agreements or explicitly accepted order terms take precedence for the services they cover.
2. Preview service
Smerio provides educational content and an early-access workspace for exploring business messaging and preparing configurations. The current messaging lab simulates message handling, delivery states and replies. It does not establish live RCS, SMS or MMS delivery, sender approval, carrier coverage or a production-ready integration.
Features may be incomplete or change. Do not use this preview for emergency communications, critical notifications or workflows requiring guaranteed availability or delivery. There is no uptime or support-response commitment unless agreed separately.
3. Accounts and security
Provide accurate account information, protect your credentials and use only accounts and workspaces you are authorised to access. You are responsible for activity you authorise through your account and API credentials. Contact support promptly if you suspect misuse. Third-party sign-in is also subject to the provider’s terms.
4. Acceptable use and messaging responsibilities
Do not use Smerio to send spam, impersonate others, distribute unlawful or harmful content, infringe intellectual property, bypass access controls or interfere with the service. Do not probe accounts or systems without authorisation.
Use synthetic or appropriately authorised information in the lab. You must have permission to use submitted brands, logos, websites and contact details. Before any real messaging, you must establish the required recipient permissions and legal basis, honour opt-outs, and satisfy applicable provider, carrier and sender-registration requirements. Saving a draft does not satisfy those requirements.
5. Your content and privacy
You retain rights to content you submit. You allow Smerio to host, process and display that content as needed to provide the features you request, maintain security and handle support. This permission does not transfer ownership of your brand or content.
The Privacy Policy explains account, workspace and website data handling. Do not upload sensitive personal data or production customer lists to the simulated lab. Processing customer messaging data in production requires appropriate data-processing arrangements before activation.
6. Pricing and future production access
No paid subscription, production messaging rate or service commitment is established merely by using this preview. Any paid service must present its pricing, scope, billing terms and applicable conditions before you agree to it. Test usage counters do not themselves represent an invoice.
Real messaging would require separate activation and approval. Coverage, delivery, registration fees and fallback charges depend on the relevant providers and networks; they are not guaranteed or assumed free by these terms.
7. Smerio materials and third-party services
Smerio’s name, visual identity, software and documentation remain subject to their respective intellectual property rights. You may use the available interface and documentation for evaluating and integrating with the service within the permissions provided. Third-party components retain their own licences.
Linked websites, identity providers and external tools operate under their own terms and policies. Smerio cannot guarantee their availability or decisions, including sender approval or access to an external platform.
8. Suspension, closure and changes
Access may be restricted to address misuse, security threats or legal obligations. Where practical and lawful, we will explain the reason and allow the issue to be resolved. You may stop using the preview and request account closure at support@smerio.com. Data retention and deletion are described in the Privacy Policy.
The preview may be changed or discontinued. Where practical, affected account holders will receive notice of material changes. Updated terms will be published at this URL with a new date; changes requiring agreement must be presented for acceptance rather than treated as retroactively accepted.
9. Responsibility and applicable rights
The preview is provided on an “as available” basis to the extent permitted by law. Its examples and simulated statuses should not be relied on as evidence of production performance. No exclusion in these terms removes liability or rights that cannot lawfully be excluded, including mandatory consumer rights where applicable.
Governing-law and dispute-resolution provisions remain to be completed with the operator’s legal details. Nothing in this provisional version limits access to protections or courts available under mandatory applicable law. Contact support first so we can try to resolve a concern.
